Wrongful Termination

Losing a job is never easy. But when a firing seems especially unfair, it may be because your legal rights have been violated. Everyone should be able to work without fear that they will be fired because of discrimination or retaliation. When an employer fails to provide this environment, we are there to hold them accountable.

If you believe you were wrongfully fired, and discrimination is to blame, the attorneys of Alexander Morrison + Fehr, LLP in California can assist you in filing a claim. With decades of combined experience in employment law, we have the skills and resources to guide you through the process.

What Does It Mean To Be “Wrongfully Terminated”?

People, unfortunately, often lose their jobs for unfair reasons. But wrongful termination as a legal claim has a specific definition. Many workers are considered “at-will” employees, meaning they can be terminated at any time for essentially any reason, as long as it is not a discriminatory reason. Certain adverse employment actions are illegal, namely when the termination is based on a violation of public policy, such as based on a discriminatory reason. Employers are also prohibited from firing an employee who acts as a whistleblower concerning issues at their job.

Other situations of unlawful termination include:

  • Dismissal that violates the employee’s contract
  • Firing when the employee complains about safety violations
  • Retaliation when the employee has acted as a witness for a co-worker or lodged a complaint
  • Retaliation for complaining to a supervisor or human resources that you or a co-worker has been subjected to discrimination, harassment, retaliation or the like
